Waiver/ Formulario de exención
In order to attend, participants must read and sign our waiver. The photo release at the bottom of our registration form is optional. While safety and fun are top priorities for this program, there is inherent risk with outdoor programs.
Para poder asistir, los participantes deben leer y firmar nuestra exención de responsabilidad. La autorización para utilizar fotografías que se encuentra en la parte inferior de nuestro formulario de inscripción es opcional. Si bien la seguridad y la diversión son las principales prioridades de este programa, los programas al aire libre conllevan riesgos inherentes.

In consideration of being allowed to participate in any way in the program, related events and activities, I the undersigned, acknowledge, appreciate, and agree that (check on our registration form that you have read and agree to this waiver)
En consideración de poder participar en cualquier manera en el programa, eventos relacionados y actividades, yo el abajo firmante, reconozco, aprecio y estoy de acuerdo que (Marque en nuestro formulario de registro que ha leído y acepta esta exención de responsabilidad):
1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death.

2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for the Participant’s participation.

3. I am voluntarily allowing the Participant to participate in the aforementioned activity and I am allowing the participation in the activity entirely at my own risk.

4. The Participant willingly agrees to comply with terms and conditions for participation. If any unusual significant hazard is observed by the Participant during his/her/their presence or participation, he/she/they will remove himself/herself/themself from participation and bring such to the attention of the nearest Maine Outdoor School staff immediately.

5. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless Maine Outdoor School, L3C, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns from any and all claims, demands, losses, and liability arising out of or related to any injury, disability, or death the Participant may suffer, or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.
Yo, por mi mismo/a y en nombre de mis herederos, cesionarios, representativos personales y familiares por el presente indemnizo y libero de responsabilidad a Maine Outdoor School, L3C sus afiliados, administradores, miembros, agentes, abogados, personal, voluntarios, herederos, representativos, antecesores, sucesores, y asignados de todas las demandas, reclamos, pérdidas, y responsabilidad que resultan de cualquier herida, discapacidad, o muerte que el participante pueda sufrir, o la pérdida o daño de persona o propiedad, si es resultado del descuido del participante u otro, en la mayor medida permitida por la ley.

I acknowledge that I have carefully read this “Waiver and Release” and fully understand that it is a release of liability. I expressly agree to release and discharge Maine Outdoor School, L3C, and all its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns, from any and all claims or causes of action and I agree to voluntarily give up any waiver of right that I otherwise have to bring a legal action against Maine Outdoor School, L3C for personal injury or property damage.

This Agreement was entered into at arm’s-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both the Participant’s legal guardian and Maine Outdoor School, L3C agree to this Agreement.

I affirm that I am of the age of 18 years or older, and that I am freely signing this agreement. I certify that I have read this agreement, that I fully understand its content, and that this release cannot be modified orally. I am aware that this is a release of liability and a contract that I am signing it of my own free will.I hereby certify that I am the participant or the parent or guardian of the above named participant, and do hereby give my consent without reservation to the foregoing on behalf of this individual.
